New Fire Safety Law- Compliance Required

The Fire (Scotland) Act 2005 Part 3 and The Fire Safety (Scotland) Regulations 2006 have to be complied with from the 1st October 2006. It means you-The Employer/Owner has added responsibilities. You must have a Fire Risk Assessment carried out and recorded if 5 or more persons are employed. Staff must be nominated and trained in Fire-fighting and Evacuation procedures. You must also have an Emergency Fire Action Plan.

Fire Safety in Residential Care Homes

The Scottish Executive issued the first of the proposed eleven pieces of guidance on the 28th November 2005. The draft document is for Fire Safety in Residential Care Homes and it is no surprise that this is the first of the guidance documents. The Care Home Sector is still in a state of shock after the fire at Rosepark Care Home in Uddingston, Lanarkshire which occurred on the 31st January 2004 where fourteen people died in a fire. The results of the fatal enquiry report will be published soon. The document helps those with Fire Safety responsibilities to understand what Fire Risk Assessments involve, considers various fire safety measures and sets out benchmarks to assist with assessing the adequacy of existing measures.

Welcoming publication of the draft guidance Deputy Justice Minister Hugh Henry said: “Too many lives are lost each year to fires, many of which could have been avoided. It also provides a further opportunity to make sure that everyone in the Care Home sector is aware of the fire risks around them, and that they have strategies in place to minimise them, as well as giving those outwith that care sector the chance to help shape future guidance for their sectors.  None of us can afford to be complacent when it comes to fire safety because complacency kills.

 

 

Fire Safety is a serious matter and the onus is firmly placed upon the responsible person for, in particular

  • Duty to take General Fire Precautions.
  • To carry out a Fire Risk Assessment (recorded if 5 or more persons employed.)
  • Fire Safety Arrangements
  • Fire Fighting and Detection
  • Capabilities and Training     

Failure to comply with these Acts is an offence
